Matters beyond MIRAJ’s reasonable control

MIRAJ is not liable for any breach of this contract where the breach was caused by Act of God, insurrection or civil disorder, war or military operations, national or local emergency, acts or omissions of government, highway authority or other competent authority, MIRAJ compliance with any statutory obligation or an obligation under a statue, industrial disputes of any kind (whether or not involving MIRAJ employees), fire, lightening, explosion, flood, subsidence, weather of exceptional severity, acts of omissions of persons for whom MIRAJ is not responsible (including in particular other telecommunication service providers) or any other cause whether similar of dissimilar outside MIRAJ reasonable control.

MIRAJ cannot take any reponsibility for the accuracy of information contained on the miraj.co.uk website or on pages it links to.

Limited Liability: USE MIRAJ SERVICES AT YOUR OWN RISK

All services and information is provided on a AS IS and BEST ENDEAVOURS basis.

For the avoidance of doubt MIRAJ has no obligation duty or liability in contract, tort for breach of statutory duty, negligence or otherwise beyond that a duty to exercise reasonable skill and care.

This contract is to be treated as made in England according to English Law and subject to the jurisdiction of the English courts.

services purchased through the web site. If any problems arise from the supply of goods or services by a supplier, you must take issue with the supplier and not with us. MIRAJ has taken every effort to ensure that the information on this website is correct, accurate and up to date. However we cannot guarantee that it will always be fault free and therefore, MIRAJ takes no responsibility whatsoever for information that is incomplete, inaccurate or out of date.
MIRAJ shall not be held liable to any individual or business for any damage or loss which may have occurred from the use of any matter contained on this website.

MIRAJ assumes no responsibility whatsoever for any links to the Internet or other third party websites from its website. Once you activate these links you will leave this website and MIRAJ will not be responsible, or liable, for the content of any other websites on the Internet to which you may visit from its site.

 

Terms and conditions for Internet Access use

Please always remember this is a public facility, the terminals are monitored and accessing material considered unacceptable or offensive by staff will have session terminated without refund.

We cannot guarantee the privacy of e-mails or security of on-line transactions. Do not give MIRAJ address for delivery of goods ordered on the internet.

1.0 When You Finish your Session – ALL FILES STORED LOCALLY WILL BE LOST
Information stored on our computers may be deleted at any time and definately at the end of your session. When you log off, the computer will restart and any data/downloads or settings that have been saved locally will be destroyed. Please be aware that once the log off process has started it cannot be stopped and you will not be able to retrieve any data saved locally.

If you want to keep information that you have downloaded or typed then we recommend that you either print or save to CD, USB flash disk or floppy disc BEFORE ENDING YOUR SESSION.

1.0.1 GOOD PRACTICES- save a draft version of your work every 15 minutes or so

When you are writing or updating long letters, emails, websites or other work we recommend that, as a precaution against unexpected system freeze/crash/corruption/powerloss/restart, you save a draft version of your work every 15 minutes or so onto external device such as your email server, CD, USB flash disk or floppy disc.

1.1 Acceptable Service (Internet) Use

the browsing or downloading of material of an illegal or offensive nature is not permitted. This includes but is not limited to: copyrighted movies, music (mp3’s), or software, hacking/cracking material, or adult material. There are no exceptions to this policy.

1.1.2 You may only use the Service for legal purposes and are forbidden to:

1.1.2.1 access, download, copy, publish, distribute or disseminate any material which is:
1.1.2.1.1 defamatory, obscene, indecent, menacing or which may incite anxiety, racial prejudice or hatred;
1.1.2.1.2 comprising any material which infringes third party Intellectual Property Rights (including, but not limited to copyright in: literary works, directories, databases, music, trademarks, logos etc) without the appropriate (implied or express) authorisation for use provided by such third party;
1.1.2.2 access any unauthorised on-line gambling sites (including betting, gaming and bingo pursuant to the Gaming Act 1968;
1.1.2.3 modify, copy, distribute, transmit, reverse engineer, display, perform, reproduce, publish,
license, create derivative works from, transfer, or sell any information, software, products or services
obtained from the MIRAJ web site and Internet in relation to any aspect of the Service, including but not limited to any other web site;
1.1.2.4 distribute or disseminate a software virus or any other destructive or harmful software file or
programme;
1.1.2.5 send “spam” or other unsolicited bulk email;
1.1.2.6 hack into any part of the Service and/or third party web site service; and/or
1.1.2.7 provide or disclose to or share with any third parties your User ID or Credit Number and/or password and you shall not access any materials of another by logging into this web site using a third party’s User ID or Credit Number and password.

1.1.3 For the avoidance of doubt you and not MIRAJ will be solely responsible for any civil and/or criminal liability arising from any breach of these Terms and Conditions by you and/or any illegal activity carried on by your use of this Service.

1.1.4. Your use of the Service and Third Party Web Sites

1.1.4.1 By using our Service you will be able to browse online information and access third party web sites including, but not limited to, search engines, interactive news rooms directories and/or databases (“third party web site(s)”).

1.1.4.2 We do not control such third party web sites, and are not responsible for their content. When you access third party web sites, you do so at your own risk. Your use of each third party web site is subject to the terms of use and other guidelines, if any, contained within each respective third party web site.

1.1.4.3 You agree to click on the links to and familiarise yourself with the terms of use and other terms and guidelines found throughout this web site, third party sites and abide by them if you choose to use the sites, pages or services to which they apply.

1.1.5. Subscriptions/Purchases
1.1.5.1 Any contract you make for the supply of any other goods and services will be with the relevant third party, facilitated through the respective third party web site and on that third partys terms of sale unless otherwise specified.

1.1.5.2 You agree to pay for any goods and/or services ordered from this web site including, where
applicable, all VAT and/or applicable governmental tax or levy.

1.2 Minors
children 12 or under must be accompanied by an adult. If we are in doubt of the child’s age only a UK birth certificate, passport or drivers licence (for children aged 17 and above) may be used as proof of age. We advise parents accompanying children 12 or under that our games may not be suitable. Children over 12 can play any game as permissible by law and ESRB rating of the game.

1.3 CD/DVD Burning
MIRAJ does not accept any liability for the actions of its customers with regards to the burning of CD’s or DVD’s at its premises or for actions taken on the behalf of our customers as result of their request to burn their data files to CD/DVD. Customers must adhere to all trademark and copyright laws. Customers are required to indemnify MIRAJ, its staff and directors in full against all damages, legal costs and any other penalties and costs that MIRAJ may become liable for directly or indirectly as a result of having requested data to be burnt to CD/DVD. Please see “CD/DVD Burning Agreement”.

1.4 Printing
is provided as an additional chargeable service for customers hiring a PC. Customers are kindly reminded to check their documents before sending them to the printer.
All printing done by customers intentionally, accidentally or carelessly must be paid for in full.

2.1 CCTV recording
CCTV is in operation in all stores for the protection of our customers, security, staff and stock and will be used in investigation or legal case. Recording is done 24/7 both onsite and offsite.

2.2 Customer confidentiality
MIRAJ does not accept any liability to customers or third parties for breaches of confidentiality due to technological reasons outside the reasonable control of MIRAJ, or breaches caused by customers to third parties. Customers are required to comply with all applicable laws and contractual obligations concerning confidentiality and data protection.

2.3 Customer’s Personal Property
MIRAJ does not accept responsibility for customer property and to the extent reasonable excludes liability for the loss, damage or theft of any customer property brought onto the premises. Customers are reminded not to leave any personal property unattended at any time.

3.1 Food and Drink Policy
customers are permitted to bring drinks and cold food from other retail establishments. We do not allow hot food to be brought onto the premises.
Customers are not permitted to consume alcohol on the premises.

3.2 Noise Policy
we permit the reasonable use of mobile phones and personal music equipment on the premises, but we kindly ask all customers to be respectful and considerate of the people around them. We reserve the right to ask customers to refrain from such action where it is affecting other customers or our staff.

3.3 Customer conduct
MIRAJ reserves the right at its discretion to ask customers to refrain from conduct or to leave its premises. Conduct which may give rise to such action includes but is not limited to breaches or potential breaches of any applicable laws, regulations or contractual obligations, conduct which affects other customers or our staff, conduct which puts our equipment or software at risk, or breaches or potential breaches of any of our terms and conditions.

3.4 Refunds
Internet Service – MIRAJ Internet Service is provided on an ‘internet connection only’ basis and is not responsible for any external web sites or services. Refunds (or discounts) will not be given for unsuccessful attempts to connect to any external website or service. External sites and services are beyond our control.

Products – Refunds are discretionary and will not be given without a proof of purchase and return of the product is in its original condition (not damaged, used, or removed from its packaging).

Phone Cards and Top-ups (including vouchers) – we regret that refunds cannot be given under any circumstance. Customers should contact the service provider directly regarding any refund or service issues.

3.5 Changes of Rates and Conditions
The Company reserves the right to change any rates, classifications and any of these terms and conditions at its discretion. The rates payable and the terms and conditions applicable shall be those in force at the time of order or purchase.
